Coleman Talley Partners Tim Tanner and Ed Preston Secure a Favorable Jury Verdict in an Environmental Lawsuit
In a two-week jury trial held in the United States District Court for the Northern District of Georgia, the Honorable Charles Pannell, presiding, Coleman Talley Partners Tim Tanner and Ed Preston secured a favorable jury verdict in an environmental lawsuit. The complaint was brought by the City of Mountain Park, Georgia, against several developers including Coleman Talley clients, Chatham Holdings Corporation and Lakeside at Ansley, LLC. After approximately five years of discovery, and a two week trial in which the Plaintiff sought millions in damages, a jury awarded only $35,000.00 in damages to the Plaintiff. Despite the award, the jury further concluded that Chatham was less responsible than the Plaintiff, which resulted in the damage award being stricken by Judge Pannell. The jury also concluded that neither attorney’s fees nor punitive damages were warranted in the case.
